Article 1: Definitions
In these Terms and Conditions the following terms are defined:
- Provider: Taxi Centrale Amsterdam Airport, registered in the Trade Register of the Chamber of Commerce under number 70140143.
- Offer: The offer of the Provider concerning the transport of the Customer by a Carrier (third party) at a pre-determined Ticket price.
- Luggage: The collective or individual classification of baggage into Hand Baggage, Medium Baggage and Large Baggage.
- Special Passenger Transport: The transport of disabled, dependent or minor persons for whom a child seat or maxi-cosi is required.
- Customer: The natural person who purchases the Services from the Provider, not acting in the exercise of a profession or business.
- Services: The facilitation of transportation of the Customer by the Carrier against payment of the Ticket price.
- Agreement: The agreement between Provider and Customer for the provision of Services by the Provider.
- Ticket: The document provided by the Provider after the conclusion of the Agreement.
- Ticket price: The agreed price for the Ticket per Offer and the Agreement based thereon.
- Carrier: The natural or legal person who transports persons and baggage.
- No-show: When a taxi arrives at the agreed location, but the Customer does not show up without cancellation.
- Hand luggage: Baggage with a maximum dimension of 55 x 25 x 35 cm (L x W x H).
- Medium Luggage: Baggage with a maximum dimension of 150 cm (L + W + H).
- Large Luggage: Baggage with a maximum dimension of 180 cm (L + W + H).
Article 2: Applicability of General Terms and Conditions
These General Terms and Conditions apply to every Offer and Agreement of the Provider.
Article 3: Agreement & Ticket
On www.taxicentrale-amsterdamairport.nl the Customer can make a reservation for a taxi. The price stated on the Ticket is a fixed price. The Customer must provide the details as completely as possible. The Agreement is concluded as soon as the Customer accepts the Offer and the Provider receives payment. The Provider will provide a confirmation email after the Agreement has been concluded. The Ticket is personal and non-transferable, unless otherwise agreed in writing between the Carrier and the Customer. The Carrier is only obliged to transport the Customer upon presentation of the Ticket.
Article 4: Changes, Cancellation & Restitution Ticket price
The Customer may change or cancel the Agreement by email or the link in the confirmation email. A change can be submitted up to 24 hours before the originally booked transport time. Cancellations must be made in writing and no later than three (3) hours before transport to be eligible for a refund. If the cancellation is made within three (3) hours before transport, there is no right to a refund. After a legitimate cancellation, the Ticket Price will be refunded within thirty (30) days, minus 10% administration costs with a minimum of €15.
Article 5: No-Show
A No-Show means that the taxi arrives at the agreed location, but the Customer does not show up without cancellation. In case of a No-Show, the Customer is obliged to pay the full Ticket price. Refund is not possible.
Article 6: Baggage
The Customer may only take the Baggage as stated on the Ticket. Additional baggage is only permitted after written agreement with the Provider, whereby additional costs will be charged. The Provider or Carrier reserves the right to refuse dangerous or legally prohibited baggage. The Provider is not responsible for lost or damaged baggage.
Article 7: Transport of Animals
Animals may only be taken with prior permission from the Provider. Pets must be transported in a portable basket or bag. The Provider reserves the right to refuse animals that cause a nuisance. Assistance dogs are allowed in all cases.
Article 8: Special Passenger Transport
Special Passenger Transport is only possible after written permission from the Provider, provided that the request is submitted no later than three (3) days before the date of transport. The Provider reserves the right to refuse Special Passenger Transport if it causes danger or hindrance.
Article 9: Delay
Due to external circumstances, the taxi may arrive 15 minutes earlier or later than the agreed time. The Customer must take this into account. The Provider is not liable for any damage resulting from delay during transport, unless otherwise provided by law.
Article 10: Transport and Conditions of Carriage
The Carrier or a partner selected by the Carrier shall provide the Customer's transport. The Carrier's general conditions of carriage shall apply to the agreement. In the event of any conflict, these General Conditions shall prevail.
Article 11: Complaints procedure
Complaints regarding the performance of the Agreement must be submitted in writing to the Provider within ten (10) working days.
Article 12: Provider Liability
The Provider is not liable for any damage, including consequential damage or immaterial damage, related to the Services or the transportation of Customer and/or luggage. Liability is limited to the amount paid by Customer to the Provider in the current calendar year, unless the damage is caused by intent or recklessness of the Provider.
Article 13: Force Majeure
The Provider is not responsible for the fulfillment of obligations if this is prevented by force majeure, such as accidents, extreme weather conditions or traffic conditions beyond the control of the Provider.
Article 14: Privacy
The Customer is deemed to have taken note of the Provider's privacy statement and to agree to the processing of his personal data.
Article 15: Intellectual Property Rights
The intellectual property rights to all Services of the Provider belong to the Provider or to third parties from whom the Provider has obtained rights.
Article 16: Miscellaneous
The invalidity of any provision of these General Terms and Conditions shall not affect the validity of the remaining provisions.
Article 17: Applicable Law & Choice of Forum
These General Terms and Conditions are governed by Dutch law. Only the Dutch courts are competent to settle disputes.
